Denying a stay of enforcement of demolition for property at 655 JESSAMINE AVENUE EAST. (Amend to grant a stay of enforcement for 180-day extension)

WHEREAS, on February 10, 2021, the Saint Paul City Council adopted Council File RLH RR 21-5, which ordered the removal of 655 Jessamine Avenue East within 15 days; and
WHEREAS, following the Council decision on the matter a request was made by John Ray, to review this case again and consider granting a stay of enforcement based recent family loss; and
WHEREAS, on March 3, 2021, the City Council referred the matter back to the Legislative Hearing Officer for reviewing on March 9, 2021 in order to develop a recommendation on whether the Council should grant a stay of enforcement of RLH RR 21-5;
WHEREAS, the Legislative Hearing Officer's recommendation to the City Council is forthcoming pending this included the review to grant an stay in order for of John Ray meeting the following conditions to 1) developing and submitting for consideration rehabilitation plans; 2) providing evidence of financing sufficient to execute these plans and an affidavit indicating those funds will be dedicated for this purpose; and 3) posting a $5,000 performance deposit; and
WHEREAS, the matter was reviewed on March 9, March 23, April 13, May 11, June 15 and June 29, 2021 and the Legislative Hearing Officer recommends that the City Council deny the stay of enforcement and to order the building be removed within 15 days with no option for repair conditions 1 and 2 above were not met;
WHEREAS, the matter is being reviewed again on August 10, 2021 to review signed subcontractor bids, work plan including schedule which must be submitted by close of business on August 6, 2021 and property must continue to be maintained;
WHEREAS, the Legislative Hearing Officer has reviewed these conditions with input from the Vacant Building Program Manager, and recommends that the City Council stay enforcement of City Council File No. RLH RR 21-5 for a period of 180 days as the aforementioned conditions were met on Tuesday, August 10, 2021; and, Now, Therefore, Be It,
RESOLVED, that the Saint Paul City Council hereby grants a 180-day extension for the rehabilitation or razing and removal of the structures denies the stay of enforcement of RLH RR 21-5.
