Making finding on the appealed substantial abatement ordered for 655 JESSAMINE AVENUE EAST in Council File RLH RR 21-15.  (Amend to grant 180 days)

WHEREAS, the City Council adopted RLH RR 21-15 on August 11, 2021 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 655 Jessamine Avenue East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on February 22, 2022 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions forthcoming, pending owner submits 1) updated work plan including bids, 2) updated proof of financing by February 28, 2022 and 3) property must continue to be maintained and 4) post an additional $5,000 performance deposit;

 

WHEREAS, on March 2, 2022, the Legislative Hearing Officer reviewed updated schedule, work plan, bids submitted by appellant and found it acceptable, as well as posting of an additional $5,000 performance deposit on March 1, 2022; therefore, she will recommend granting an additional 180 days for completion of the rehabilitation and will review updated plans and financing for completing the work if not done in 180 days at the September 13, 2022 Legislative Hearing to develop a recommendation for Council consideration; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is stayed on its finding pending recommendation of the legislative hearing officer forthcoming.
