WHEREAS, the City Council adopted RLH RR 17-12 on June 21, 2017 which granted 180 days to abate the nuisance conditions at 544 Minnehaha Avenue West; and
WHEREAS, the Legislative Hearing Officer reviewed this case on December 26, 2017, January 16, 2018, January 30, 2018 and February 13, 2018 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions [were / were not] abated;
WHEREAS, the Legislative Hearing Officer, based on results from these hearings which indicate the project is 30% complete 7.5 months after the 6-month grant of time from the City Council on June 28, 2017, recommends that, in order to receive an 180-day extension: 1) revised work plans with current contractors, budgets and documentation of financial capacity be submitted and approved; 2) the initial $5,000 performance deposit be continued and 3) a second $5,000 performance deposit be posted by February 23, 2018; and
WHEREAS, these conditions were not met by the above-established deadline; however, Council gave 3 additional extensions for the conditions to be met and they were met by Council meeting time on March 21, 2018; and
WHEREAS, the above listed were met, albeit well-past the original deadline, the Legislative Hearing Officer recommends that the City Council grant to September 14, 2018 for the nuisance building to be abated by razing and removal or rehabilitation, as evidenced by issuance of a Certificate of Code Compliance; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is [abated and the matter resolved / not abated and therefore authorizes the Department of Safety and Inspections to proceed with this nuisance abatement]. if the above conditions for an extension are not met.; however, conditions for an additional grant of time for the abatement have been met and therefore, the City Council grants to September 14, 2018 for the nuisance building to be abated by razing and removal or rehabilitation, as evidenced by issuance of a Certificate of Code Compliance.
