Title

Making finding on the substantial abatement ordered for 975 MARSHALL AVENUE in Council File RLH RR 21-23.

 

Body

WHEREAS, the City Council adopted RLH RR 21-23 on May 12, 2021 which granted an additional 90 days until August 12, 2021 to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 975 Marshall Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on August 10, 2021 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated but building inspector had determined the rehabilitation project was 95% complete; therefore, the Legislative Hearing Officer recommends continuing the $5,000 performance deposit and grant an additional 90-days until November 18, 2021 for completion of the rehabilitation; Now, Therefore Be It

 

RESOLVED, that at the conclusion of the 90-days grant of time, the Council will receive a report from the Legislative Hearing Officer with findings on the status of the nuisance abatement; And Be It Further

 

RESOLVED, that a Legislative Hearing is scheduled for November 23, 2021 at which owners, interested parties and Department of Safety and Inspection staff will present information on the current building conditions and progress toward abatement of the dangerous/nuisance conditions and the resulting findings will be presented to the City Council at a public hearing on December 1, 2021 for its consideration; And, Be It Further

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer granting an additional 90-days for rehabilitation
