Approving adverse action against the Auto Repair Garage license held by Xpert Auto Center, Inc., d/b/a Xpert Auto Center at 1160 Rice Street.

WHEREAS, the Auto Repair Garage license held by Xpert Auto Center, Inc. d/b/a Xpert Auto Center (License ID #20170000913) for the premises located at 1160 Rice Street in Saint Paul was the subject of a Notice of Violation sent December 13, 2017, stating that during a second re-inspection of the licensed premises on November 16, 2017 a DSI Inspector documented three (3) repeat license condition violations; and
WHEREAS, the three (3) license condition violations documented were: 1) Twenty-four (24) vehicles were parked on the premises and in the drive lanes in violation of approved site plan and license condition #1; 2) Striping of the parking lot was changed without editing the site plan on file with DSI in violation of license condition #2; 3) Two (2) vehicles were obstructing the northern driveway to Rose Avenue and one (1) vehicle was obstructing the curb cut onto Rice Street in violation of license condition #10; and
WHEREAS, this was the first (1st) violation of the licensee’s license conditions; and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee responded to the Notice of Violation to request a public hearing which was then scheduled on January 17, 2018; so therefore be it
RESOLVED, Xpert Auto Center, Inc. d/b/a Xpert Auto Center is hereby ordered to pay a $500.00 matrix penalty for three (3) repeat license condition violations documented by a DSI Inspector during a second re-inspection on November 16, 2017.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
