WHEREAS, in the matter of the Appeal of David A. Unger to a Fire Certificate of Occupancy Inspection Correction Notice at 1111 CASE AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 5-inch variance on the openable height of the egress windows in the upper floor north and south bedrooms; deny the appeal on the upper floor east bedroom and cannot be used as sleeping room; deny the appeal on the ceiling height in the upper floor north and south bedrooms and grant an extension to August 1, 2012 to vacate the illegal units; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
