Purpose of Appeal: #7 Only a portion of the wall was in need of repair, not all of it. #7 The bulge in the wall was present when I bought the property in 1988 and has not moved and shouldn't be an issue.

WHEREAS, in the matter of Appeal of Ray Moore to a Correction Notice - Re-Inspection Complaint at 1258 ALBEMARLE STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the following deadlines:

1) grant to June 1, 2020 for retaining wall repair and orders relating to painting, scraping and caulking; and

2) grant to December 9, 2019 for the balance of orders, compliance with Item 7 is based on the November 11, 2019 Larson Engineering report (reviewed and accepted by the City’s Structural Engineer) and includes the following:

a. Around the perimeter of the two main level windows on the north side of the home, replace the wood that only goes up to a portion of the jamb and replace it with wood that extends up to the window head;
b. Remove and replace the deteriorated sealant around the perimeter of the window;
c. Deteriorated wood member around the perimeter of the basement window should be removed and replaced, if found to be rotten; and
d. Monitor masonry on the north side of the home, with an engineer reviewing a year from now to evaluate the condition of the existing wall at this location. At the time of the follow-up evaluation, if the mortar has been displaced or severely cracked, remove the bowed-out portion of the wall and rebuilding this portion of the wall; Now, Therefore, Be It
