Making finding on the appealed nuisance abatement ordered for 1450 DALE STREET NORTH in Council File RLH SAO 21-40. (Legislative Hearing on July 27, 2021)

WHEREAS, the City Council adopted RLH SAO 21-40 on July 14, 2021 which granted an extension to July 16, 2021 to abate the nuisance conditions at 1450 Dale Street North; and
WHEREAS, the Legislative Hearing Officer reviewed this case on July 20 and 27, 2021 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions forthcoming partially abated: 1) non-compliance with the vehicle abatement order; 2) partial compliance with the summary abatement order to clean the yard; 3) partial compliance in removal of unstable/ramshackle structures and structures constructed without adequate setback from the property line; and 4) non-compliance with orders to repair or remove unstable portions of fence not built in compliance with the MN State Building Code; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council authorize the abatement of those items not in compliance, with the exception of the fence and fencing material, as she recommends an extension to September 7, 2021 for completing the repair or removal of the fence - the completion of which shall be determined by the Building Official; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the findings and recommendations of the legislative hearing officer that the nuisance condition is forthcoming, pending July 27 20, 2021 Legislative Hearing.
