Denying request for a stay of enforcement of Council File RLH RR 16-8 ordering the rehabilitation or razing and the demolition of the structures at 595 JESSAMINE AVENUE EAST within 15 days after the June 1, 2016 City Council Public Hearing.

WHEREAS, City Council File RLH RR 16-8 ordered the rehabilitation or razing and the demolition of the structure of 595 Jessamine Avenue East within 15 days after the June 1, 2016 City Council Public Hearing; and
WHEREAS, a request was made to the City Council to review this case again and to consider the possible grant of a stay of enforcement; and
WHEREAS, the Legislative Hearing Officer conducted hearings on June 14, 2016 and July 12, 2016 to review this request; and
WHEREAS, the Legislative Hearing Officer indicated that as a first step, a $5,000.00 performance deposit would need to be posted with the Department of Safety and Inspections by June 17, 2016; and
WHEREAS, if the deposit is posted, the owner would be given to July 12th to
1. provide information on adequate funds being dedicated for the project (a line of credit, sworn construction loan or a bank statement). City’s estimate the repair of the structure between $60,000 to $75,000;
2. obtain a new code compliance inspection for a single family dwelling if owner intends to rehabilitate the dwelling as a single family home, noting that the previous code compliance inspection was for a duplex inspection);
3. provide a work plan, including timelines, for the rehabilitation of the property, including contractor bids; and
4. provide a legal contractual agreement between Dao Yang and Xeng Xiong indicating that Xeng Xiong is willing to come in as a third party to do the rehab;
WHEREAS, the Legislative Hearing Officer recommends the Council deny the request for a stay of enforcement of Council File RLH RR 16-8 ordering the rehabilitation or razing and the demolition of the structures at 595 Jessamine Avenue East within 15 days after the June 1, 2016 City Council Public Hearing based on the the failure to post the $5,000 performance deposit by June 17; Now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, denying a stay of enforcement of Council File RLH RR 16-8 ordering the rehabilitation or razing and the demolition of the structures at 595 Jessamine Avenue East within 15 days after the June 1, 2016 City Council Public Hearing; and be it
RESOLVED, the Saint Paul City Council hereby affirms its direction to the Department of Safety and Inspections to abate the nuisance and dangerous conditions by removal of the structures within 15 days.
