Title

Consideration of a potential stay of enforcement of demolition for Derek Thooft, Thooft Law LLC, on behalf of Lorie Miller, for property at 975 HUDSON ROAD. 

 

Body

WHEREAS, on January 12, 2022, the Saint Paul City Council adopted Council File RLH RR 21-24, which ordered the removal of 975 Hudson Road within 15 days; and

 

WHEREAS, following the Council decision on the matter a request was made by Derek Thooft, on behalf of Lorie Miller, to review this case again and consider granting a stay of enforcement; and

 

WHEREAS, on February 9, 2022, the City Council referred the matter back to the Legislative Hearing Officer for reviewing on February 22, 2022 in order to develop a recommendation on whether the Council should grant its stay of enforcement of RLH RR 21-24;

 

WHEREAS, the Legislative Hearing Officer's recommendation to the City Council is forthcoming pending this review to grant an stay in order for Derek Thooft, on behalf of Lorie Miller, to 1) develop and submit for consideration rehabilitation plans; 2) evidence of financing sufficient to execute these plans; 3) affidavit dedicating funds for the project; 4) contract with third party doing rehab; 5) post new $5,000 performance deposit if a third party contract is approved; and 6) bring real estate taxes current; Now, Therefore, Be It,

 

RESOLVED, that theLegislative Hearing Officer hereby recommends the Council stays/denies the stay of enforcement of RLH RR 21-24, and will refer the matter back to the City Council under cover of separate resolution.
