Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Erag Auto LLC (License ID # 20210000368), d/b/a the same, for an Auto Repair Garage, located at 1033 Thomas Avenue.

WHEREAS, Erag Auto LLC (License ID # 20210000368), d/b/a the same, located at 1033 Thomas Avenue, has applied for a Class N license for a Auto Repair Garage Gambling license; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of May 27, 2021 to June 25, 2021; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on July 19, 2021; and
WHEREAS, the objections were related to noise from automotive tools and equipment, cross road traffic, parking, negative environmental impact concerns, etc.; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the City to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application for an Auto Repair Garage, located at 1033 Thomas Avenue., for Erag Auto LLC (License ID # 20210000368), d/b/a the same, be approved with the following conditions:
CONDTION #1 & 2 PER ZONING CONDITIONAL USE PERMIT (CUP) #2020-073203:
1. Final plans approved by the Zoning Administrator for this use shall be in substantial compliance with the plan submitted and approved as part of this application.
2. Vehicles awaiting repair, or that have been repaired and are awaiting pick-up, shall be stored on-site.
