Making finding on the appealed substantial abatement ordered for 489 SHERBURNE AVENUE in Council File RLH RR 19-11.  (Amend to grant 180 days)

WHEREAS, the City Council adopted RLH RR 19-11 on January 15, 2020 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 489 Sherburne Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on June 23, 2020 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated and the project was determined to be approximately 20% complete by the 180-day deadline established by the City Council; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council continue the current $5,000 performance deposit (rather than forfeit for non-compliance) and grant an additional 180 days to complete the rehabilitation if the following conditions are met by July 6, 2020:

 

1.        Provide an updated scope of work / sworn construction statement indicating the contractors, bids and schedule of the work.

2.       Provide updated documentation of financial capacity to complete the rehabilitation. This documentation should include information on payments already made which can be subtracted from the total cost of the project; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated, but will grant an additional 180 days to complete the nuisance abatement since  if the above conditions are met.
