Title
Authorizing the declaration of a public sewer easement on City property in the West Side Flats redevelopment area and accepting a public sewer easement from the Housing and Redevelopment Authority within the redevelopment area.
Body
WHEREAS, several underground sewer lines exist within the West Side Flats redevelopment area, specifically within the area east of the Wabasha Street bridge and west of the Union Pacific Railroad tracks (the "Sewers"); and
WHEREAS, the Department of Public Works ("Public Works") of the City of Saint Paul ("City") requires permanent sewer easements to protect the Sewers; and
WHEREAS, the City, as owner of a portion of the land in which the Sewers are located, desires to provide a declaration of public sewer easement ("City Declaration"), as provided in the document attached hereto as Exhibit A, along with the legal description and depiction of the easement areas identified in the attached Parcels 1 and 2; and
WHEREAS, the Housing and Redevelopment Authority, as owner of a portion of the land in which the Sewers are located, has agreed to grant the City a public sewer easement ("HRA Easement"), and is now requesting that the City accept the HRA Easement, as provided in the document attached hereto as Exhibit B, along with the legal description and depiction of the easement area identified in Parcel 3; and
WHEREAS, Public Works has reviewed and approved the City Declaration and the HRA Easement and their related exhibits; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby authorize the proper city officials to execute the City Declaration and accept the HRA Easement in a form and content substantially as set forth in Exhibits A and B attached hereto; and further to authorize the recording of said documents with the Ramsey County Recorder's Office and/or Registrar of Titles.
