Title
Granting the application of Blackstone 1, LLC to rezone property at 823 Englewood Avenue from R4 Single Family Residential to RT2 Townhouse Residential, and amending Chapter 60 of the Legislative Code pertaining to the zoning map.

Body
WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 61.800 of the Legislative Code, Blackstone 1 LLC, in Zoning File 19-094-559, duly petitioned to rezone 823 Englewood Avenue, being legally described as All of Lots 5, 6, &7, Block 6; Winters’ Addition to Saint Paul, PIN 26.29.23.43.0122, from R4 single family residential to RT2 townhouse residential; and

WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on November 7, 2019, for the purpose of considering the rezoning petition, and pursuant to § 107.03 of the Administrative Code, submitted its recommendation to the Planning Commission for approval; and

WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on November 15, 2019, and recommended approval to the City Council; and

WHEREAS, notice of the public hearing before the City Council on said rezoning petition was duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of the property sought to be rezoned; and

WHEREAS, a public hearing before the City Council having been conducted, at which all interested parties were given an opportunity to be heard, the City Council having considered all the facts and recommendations concerning the petition; and

WHEREAS, the City Council, based upon the recommendation of the Planning Commission, as substantially set forth in the commission’s resolution of recommendation, #19-56, and the report of commission staff Zoning File #19-094-559 dated September 19, 2019, both of which shall be incorporated herein by reference and are further hereby adopted by the City Council as its formal statement of the legislative reasons for rezoning the said property; now, therefore
