Purpose of Appeal: Cousin with handicaps cannot afford whole house alone and 9 feet of side lot is required for a duplex classification. Property is zoned for multiple housing now. I am short 4.75 feet of side lot on unused alley grown up into trees, which will never be used as an alley due to the steep hill.

Legislative Hearing Staff Comments: I explained to the appellant that I will not review any aspect of the BZA decision and if he wanted to appeal the decision, he needed to contact BZA staff and file an appeal to go to the City Council. He indicated that while he wanted to do that, he also was looking for more time to improve his case for BZA consideration. I said the only things I will hear are whether the Fire C of O should be revoked for this violation (Ch. 40.06(a)(3) seems pretty clear on this) and the effective date of the revocation. -MM

WHEREAS, in the matter of the Appeal of Francis W. Crowley to a Revocation of Fire Certificate of Occupancy and Order to Vacate 2001 BREWSTER STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant to January 1, 2018 to 1) comply by de-converting to a single family by removing the kitchen and the locks between the two units; 2) the building must be vacated entirely; or 3) have the Board of Zoning approve this as a duplex, noting the owner must make all necessary changes (example: fire separation, smoke alarms, two furnaces/electrical services, etc) to make it a duplex and pull appropriate permits to do the repairs; Now, Therefore, Be It
