Purpose of Appeal: Per attached letter, "when I moved in after purchasing the property I had to fix the plumbing, after fixing the plumbing the weather got cold and I found out the furnace wasn't working. It was too cold to live in the property so I had to leave until I was able to fix the furnace." "in order to fix the broken furnace I would need to be able to access my property and have the non-occupancy lifted."

WHEREAS, in the matter of Appeal of Terry Scot Glass to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 646 AURORA AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council 1) grant the appeal on the revocation and order to vacate, noting the owner cannot live at the property until the water, heating units and exposed wiring issues are addressed; 2) grant an extension to May 1 to bring the aforementioned items into compliance; 3) grant until July 1, 2015 for the remaining items to be addressed; and 4) grant the appeal that the property be released from the Fire Certificate of Occupancy Program, noting Fire inspection staff will follow up on the water, heating units and exposed wiring issues; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
