Granting a permanent right-of-way easement to Ramsey County for a portion of existing Warner Road located on City property.
Body
WHEREAS, the City of Saint Paul ("City") owns a parcel of vacant land near the intersection of Warner Road and Childs Road, as depicted in Exhibit A attached hereto; and
WHEREAS, Ramsey County ("County") is reconstructing the Warner Road bridge crossing the BNSF Railway tracks north of Childs Road and has discovered that a portion of the existing roadway north of the bridge is not encumbered with a right-of-way easement; and
WHEREAS, Warner Road is owned and maintained by the County, therefore the County has requested that the City grant a permanent easement for said roadway, as depicted in Exhibits B1 and B2 attached hereto; now, therefore be it
RESOLVED, by the Mayor and Council of the City of Saint Paul, that the proper city officials are hereby authorized and directed to grant said right-of-way easement to the County in a form and content substantially as set forth in Exhibit C attached hereto.
