Purpose of Appeal
Code Compliance Report is requiring the repair of non-code items for legal occupancy status. 90% of the list is already completed, as the inspector failed to perform a legal code compliance inspection as regulated by state law. (See Application for Appeal for statutes cited.)

Appellant had a Code Compliance Report done as stipulated by the City Council in RLH VBR 12-14.
The appellant should have applied for and had a code compliance inspection completed earlier. It looks like he waited a couple of weeks after the last hearing to apply and then it took a few weeks to perform. Therefore, I gave an additional month for issuance of the code compliance certificate. I believe this building continues to be illegally occupied. ~MM

WHEREAS, in the matter of Appeal of Jarred Johnson to a Code Compliance Report at 685 ORANGE AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;
WHEREAS, the Legislative Hearing Officer's recommend that the City Council deny the appeal and require that the property be code compliant as evidenced by the issuance of a Code Compliance Certificate, or vacated by no later than June 1, 2012, noting that the owner bought and moved into a registered vacant building; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
