Accepting a sidewalk easement from developers in conjunction with the Gateway Mixed-Use Development Project.
Body
WHEREAS, Saint Paul QOZ Multifamily, L.L.C. and Saint Paul QOZ Hotel, L.L.C. ("Property Owners") are in the process of constructing the Gateway mixed-use development and hotel project (the "Project") within the property bounded by Smith Avenue North, Kellogg Boulevard West, Seventh Street West and Fifth Street West in Downtown Saint Paul (the "Development Property"); and
WHEREAS, as part of the site plan approval process for the project the Department of Public Works ("Public Works") of the City of Saint Paul ("City") is requiring permanent sidewalk easements ("Easements") over a portion of the Development Property in order to retain a 10-foot clearance from the back of the proposed Bus Rapid Transit platform which will be constructed within the City's Smith Avenue right-of-way; and
WHEREAS, the Property Owners have agreed to provide the Easements and are now requesting that the City accept the Easements, as provided in Exhibits A and B attached hereto; and
WHEREAS, Public Works has reviewed and approved the Easements as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easements in a form and content substantially as set forth in Exhibits A and B attached hereto, and does authorize the proper city officials to accept executed originals of same and record with the Ramsey County Recorder's Office and/or Registrar of Titles.
