Making finding on the appealed substantial abatement ordered for 594 BRUNSON AVENUE in Council File RLH RR 24-10.

WHEREAS, the City Council adopted RLH RR 24-10 on February 14, 2024 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 594 Brunson Avenue; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on August 13, 2024 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions forthcoming not abated, pending noting an additional grant of time would require submission and approval of updated financing, affidavit and work plan/schedule; and

 

WHEREAS, updated financing, an affidavit dedicating the financing and an updated work plan/schedule were submitted September 24, 2024, and approved by the Legislative Hearing Officer and Department of Safety and Inspection staff;

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council continue the existing $5,000 performance deposit and grant an additional 180 days to complete the nuisance abatement; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is forthcoming not abated, but extends the existing $5,000 performance deposit and grants an additional 180 days to complete the nuisance abatement; and be it

 

RESOLVED, that the Saint Paul City Council refers this matter to Legislative Hearing on March 25, 2025 to make a finding whether the nuisance condition has been abated and report that finding to the City Council April 9, 2025.
