Approving adverse action against Auto Repair Garage and Auto Body Repair/Painting Shop licenses held by Lanhart’s Auto Repair Inc., d/b/a Lanhart’s Auto Repair & Body located at 1024 - 7th Street East.

 

Body

WHEREAS, the Auto Repair Garage and Auto Body Repair/Painting Shop licenses held by Lanhart’s Auto Repair Inc., d/b/a Lanhart’s Auto Repair & Body (License ID #20030004877) for the premises located at 1024 - 7th Street East in Saint Paul was the subject of a Notice of Violation dated September 11, 2015 stating that a DSI Inspector documented violations to license conditions #3; #4; #5; #6, #7 and #13 during an inspection on September 3, 2015; and

 

WHEREAS, the licensee was also in violation of his Conditional Use Permit (#04-044-266 dated 3/26/2004) by allowing on-street storage or overnight storage of vehicles waiting for repair or pick-up; and

 

WHEREAS, this was the second incidence of violations to the license conditions within the past twelve (12) months; therefore, per Saint Paul Legislative Code § 310.05 (m) (1), the licensing office recommended a $1,000.00 matrix penalty; and    

 

WHEREAS, licensee responded to the Notice of Violation to admit to the facts of the Notice but contest the $1,000.00 matrix penalty and request a public hearing which was held on November 18, 2015; now therefore be it

 

RESOLVED, Lanhart’s Auto Repair Inc., d/b/a Lanhart’s Auto Repair & Body is hereby ordered to pay a matrix penalty of $1,000.00, staying $200 for a year if there are no further violations, for violations to license conditions #3; #4; #5; #6, #7 and #13 and a violation to the Conditional Use Permit (#04-044-266 dated 3/26/2004) documented by a DSI Inspector during an inspection on September 3, 2015. 

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
