Approving the release of easements within the MLS Soccer Redevelopment Site.
Body
WHEREAS, RK Midway Shopping Center LLC, RK University Midway LLC, Midway Lot 5 LLC and Twin Cities Metropolitan Transit Area (the "Property Owners") hold title to the property within and adjoining the plat of MLS Soccer Redevelopment, which includes a portion of the newly-completed MLS professional soccer facility, as well as surrounding land developed in support of the soccer facility and additional land to the north, south, east and west that is anticipated to be developed in the future (the "Development Site"); and
WHEREAS, the Property Owners are requesting the release of easements within the Development Site that benefit various public and private utilities; and
WHEREAS, the affected utilities have determined that their easement rights are no longer needed and may be released within the easement areas described and depicted in Exhibits A through F, attached hereto; now, therefore, be it
RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of Northern States Power d/b/a Xcel Energy (Electric and Gas), CenturyLink, Comcast, Verizon, District Energy, City of Saint Paul - Public Works, and the Board of Water Commissioners, the City, for itself and on behalf of said utilities, hereby waives, releases and terminates the easement rights described and depicted in Exhibits A through F attached hereto as follows:

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee from the Property Owners or their representative, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.
