Adding a Liquor-Outdoor Service Area (Patio) and a Liquor-Outdoor Service Area (Sidewalk) license with conditions to existing licenses held by 267 West Seventh LLC, d/b/a Parlour (License ID #20180000336) at 267 7th Street West.

WHEREAS, 267 West Seventh LLC, d/b/a Parlour (License ID #20180000336) applied for a Liquor-Outdoor Service Area (Patio) and a Liquor-Outdoor Service Area (Sidewalk) license in addition to their existing licenses for the premises located at 267 7th Street West; and
WHEREAS, the licensee currently holds a Liquor On Sale 101-180 Seats, a Liquor On Sale-Sunday, an Entertainment (A) and a Gambling Location license; and
WHEREAS, the licensee submitted “good faith” letters and obtained one hundred-three (103) out of one hundred forty-three (143) possible signatures for seventy-two percent (72%) support of approval of the Liquor-Outdoor Service Area (Patio) and Liquor-Outdoor Service Area (Sidewalk) licenses; and
WHEREAS, the Department of Safety and Inspections received no objections regarding approval of the Liquor-Outdoor Service Area (Patio) and Liquor-Outdoor Service Area (Sidewalk) licenses; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial; of the above-mentioned licenses now, therefore, be it,
RESOLVED, the Liquor-Outdoor Service Area (Patio) and Liquor-Outdoor Service Area (Sidewalk) licenses are hereby issued to 267 West Seventh LLC, d/b/a Parlour (License ID #20180000336) for the premises located at 267 7th Street West in Saint Paul with the following recommended additional license conditions:
5. Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works. Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
6. Licensee agrees to limit the placement of items associated with the sidewalk seating area (e.g., table(s)/chair(s)) on the public sidewalk to the area and number of seats shown on the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI) and Public Works. Licensee shall take appropriate action to ensure these items are contained to this approved area.
7. Licensee agrees to take appropriate action(s) to ensure that the sale, display, and/or consumption of alcoholic beverages is contained within the defined area as per the approved sidewalk seating plan on file with DSI.
