Making finding on the appealed substantial abatement ordered for 657 SHERBURNE AVENUE in Council File RLH RR 20-24. (Legislative Hearing on July 27, 2021)

WHEREAS, the City Council adopted RLH RR 20-24 on 657 Sherburne Avenue which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 657 Sherburne Avenue; and
WHEREAS, the Legislative Hearing Officer reviewed this case on June 15, 2021 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated; and
WHEREAS, the Saint Paul City Council adopts on June 23, 2021, 1) adopted the finding of the legislative hearing officer that the nuisance condition is not abated and therefore authorizes the Department of Safety and Inspections to proceed with this substantial abatement for removal of the building within 15 days with no option for repair 2) forfeited the $5,000 performance deposit posted June 29, 2020; 3) required an additional $5,000 performance deposit be posted by July 27, 2021; 4) referred this matter to Legislative Hearing for the review of plans and financing to execute the rehabilitation of the property; 5) continued the public hearing to July 28, 2021; and
WHEREAS, the Legislative Hearing Officer reviewed this case on July 13, 2021 and July 27, 2021 to determine if the nuisance conditions have been abated or a the following conditions have been met: 1) revised work plan submitted and approved, including bids and schedule; 2) evidence of financing and an affidavit indicating this financing will be dedicated for this purpose; 3) post a new $5000 performance deposit for completing the work pending; and
WHEREAS, the Legislative Hearing Officer reviewed this case on July 27, 2021 and found nuisance conditions were not abated but recommended granting an additional 180 days for completion of rehabilitation, as an additional $5,000 performance was posted, a revised work plan provided and approved, updated financial documentation and affidavit were submitted were reviewed and approved; Now, therefore, be it
RESOLVED, that at the conclusion of the 180-day grant of time, the Council will receive a report from the Legislative Hearing Officer with findings on the status of the nuisance abatement; And Be It Further
RESOLVED, that a Legislative Hearing is scheduled for January 25, 2022 at which owners, interested parties and Department of Safety and Inspection staff will present information on the current building conditions and progress toward abatement of the dangerous/nuisance conditions and the resulting findings will be presented to the City Council at a public hearing on February 9, 2022 for its consideration; And, Be It Further
RESOLVED, that the Saint Paul City Council stays action on its findings pending recommendation of the legislative hearing officer enforcement of RLH RR 20-24 and grants an additional 180 days to complete the nuisance abatement.
