Title

Approving the Legislative Hearing Officer's recommendation for the application with conditions submitted by Takeabreath LLC (License ID#20240001110), d/b/a Hotworx, for a Health/Sport Club license, located at 431 Snelling Avenue North.

Body

WHEREAS, Takeabreath LLC (License ID#20240001110), d/b/a Hotworx, located at 431 Snelling Avenue N, has applied for a Health/Sport Club Class N license; and

 

WHEREAS, the applicant notified the Union Park District Council prior to their application; and

 

WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of August 22, 2024, to September 6, 2024; and

 

WHEREAS, during the notification period, the District 13 Union Park District Council and the District 11 Hamline Midway Coalition both submitted letters of support; and

 

WHEREAS, also during the same period, an objection was received which triggered the hearing and a hearing was held on September 19, 2024; and

 

WHEREAS, the objections were related to safety; and

 

WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and

 

WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Legislative Hearing Officer recommends that the application for Takeabreath LLC (License ID#20240001110), d/b/a Hotworx, located at 431 Snelling Avenue N, be approved with the following conditions:

 

1. At least one employee or manager, trained and qualified in first aid and CPR according to standards established by rule by the Department of Safety and Inspections shall be on duty at all times that the licensed premises are in operation or open to members of the public.  Such standards shall be in conformity with standards and guidelines established by the American Red Cross with respect to water safety instructors or by the American Heart Association for similar purposes. 

2. No exercise equipment shall be used unless there is assigned at all times an employee on duty which is trained to give advice on the safe use and operation of said equipment. The staff member on duty must be on the premises.

3.  Licensee agrees take appropriate action to ensure that entry to the establishment is in accordance with the business plan on-file with DSI so that only registered members are permitted access to the facility during non-office hours, and non-members are only able to access the space during office hours.

4. Licensee agrees to provide DSI with a current employee schedule upon request from DSI. Such request will only be made if a complaint is received. The information shall be provided to DSI within 48 hours of such request.

 

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order and there are no grounds to deny the approval of the licenses.

 

The conditions affidavit was signed and submitted on September 20, 2024.
