Purpose of Appeal
Windows must be min 5 ft 2 glazed area with min 24" openable ht & 20" openable width. For units 1, 2, 5, 7, 8, 11, 12, 14, 15: one of the windows in bedroom is 18 openable + 38 openable width. The other window size is 18 openable X 29.5 openable. There are 2 each of 18 X 38 openable per unit. The original and current sash size is 44 inches high and cannot accommodate more openable space. See Item 14.

WHEREAS, in the matter of the Appeal of Alex Galonska, on behalf of Tia Park LLC, to a Fire Certificate of Occupancy Inspection Correction Notice at 1025 YORK AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 6-inch variance on the openable height of the egress windows in one bedroom of Units 1, 2, 5, 7, 8, 11, 12, 14, 15, 18 and in second bedroom of Units 1, 2, 5, 7, 8, 11, 12, 14, and 15; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
