Approving adverse action against the Mobile Food Vehicle license held by Saul Sanchez, d/b/a Lilian's Ice Cream.

WHEREAS, adverse action was taken against the Mobile Food Vehicle license held by Saul Sanchez d/b/a Lilian's Ice Cream (License ID #20040001643) for the City of Saint Paul by Notice of Intent to Suspend License dated September 2, 2011, alleging licensee failed to pay delinquent license and late fees of $364.00, submit a completed Workers' Compensation form and required information listed on the bottom of the renewal invoice; and
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
WHEREAS, on September 4, 2011, the Notice of Intent to Suspend License sent to the licensee's "other address" was returned by the United States Post Office marked: "Return to Sender - attempted not known - unable to forward."; and
WHEREAS, on September 8, 2011, the Notice of Intent to Suspend License sent to the licensee's business address was returned from the United States Post Office marked: "Moved left no address - unable to forward- return to sender"; and
WHEREAS, the licensee did not respond to either of the Notices of Intent to Suspend License sent to him to pay the delinquent license and late fees, submit required information or request a hearing; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to pay the delinquent license and late fees, submit the required information or request a hearing by September 12, 2011, the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, that the Mobile Food Vehicle license held by Saul Sanchez d/b/a Lilian's Ice Cream is hereby suspended for failure to pay delinquent license and late fees of $364.00.
