Purpose of Appeal
I have lived at 1491 Kent Street since August 2009.  The room in question (middle of the house on the north side) has never been used as a bedroom.  It is an office.  Please contact me if you have any questions. [Letter from Janice L. Mehlhoff]

Variance Recommendation
No hearing is necessary on the condition that the room is not being used as a sleeping room and that future sale or current lease, if any, is disclosed.
 
Body
WHEREAS, in the matter of the Appeal of Craft Masters Remodeling to an Egress Window Non-Compliance Determination at 1491 KENT STREET, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 7.5 inch variance on the openable height of one double hung replacement egress window measuring 16.5 inches high by 24 inches wide.  However, if Appellant is not replacing the windows to meet egress requirement, Appellant must disclosed that the room is not being used as a sleeping room in future sale or current lease; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
