Fourth Making finding on the appealed substantial abatement ordered for 595 PARK STREET in Council File RLH RR 23-12.  (Public hearing continued to April 10, 2024)

WHEREAS, the City Council adopted RLH RR 23-12 on April 26, 2023 which granted an additional 90 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 595 Park Street; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on July 25, 2023 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions forthcoming, pending issuance of the Code Compliance Certificate or forfeit additional $2,000 ($8,000 total) of the $10,000 and continue public hearing to October 181, 2023 each week until project is completed;

 

WHEREAS, the Legislative Hearing Officer recommends that the remaining $2,000 balance of the $10,000 performance be forfeited as the rehabilitation is not complete as evidenced by issuance of a Code Compliance Certificate and as required by the original order issued by the City Council in 2021 or in the 3 previous resolutions making findings on whether the nuisance/conditions have been abated and the conditions under which additional time may be granted for completion of the work,  now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated and additional the final $2,000 of the $10,000 total) of the $10,000 performance deposit is forfeited and public hearing continued to October 18, 2023 forthcoming February 21, 2024; and be it further

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative Hearing officer that the nuisance condition is abated and matter is resolved as Certificate of Code Compliance was issued on April 8, 2024.
