Approving the release of utility easement rights within a portion of vacated Clear Avenue west of Arcade Street.

WHEREAS, on May 4, 1993, Saint Paul City Council approved C.F.# 93-577 that vacated a portion of Clear Avenue west of Arcade Street and retained various utility easement rights ("Vacation Resolution"); and

WHEREAS, on June 28, 1993 the Vacation Resolution was recorded in Ramsey County property records as Document Number A2730991 and on August 24, 1993 recorded as Document Number T1024919, copies of which are attached hereto; and

WHEREAS, Dillon Tews of Loucks, Inc., on behalf of 30,000 Feet, owner of a former neighborhood bank property located at 1351 Arcade Street, Parcel ID #202922410126 (the "Property"), is now requesting the release of portions of the utility easements that encumber the Property in order to facilitate redevelopment; now, therefore, be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City of Saint Paul ("City") Department of Public Works, the Saint Paul Board of Water Commissioners, Northern States Power Company (dba Xcel Energy) and U.S. West Communications, Inc. (dba CenturyLink and Lumen), the City, for itself and on behalf of said departments and utilities, hereby waives, releases and terminates said easement rights encumbering the Property, as shown in Exhibit A (Department of Public Works), Exhibit B (Saint Paul Board of Water Commissioners), Exhibit C ( Northern States Power Company) and Exhibit D (U.S. West Communications, Inc.); and be it further

RESOLVED, that upon passage of this resolution and the City's receipt from 30,000 Feet of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intend...
