Making finding on the appealed substantial abatement ordered for 1941 UNIVERSITY AVENUE WEST in Council File RLH RR 21-60. (Amend to grant additional 180 days)

WHEREAS, the City Council adopted RLH RR 21-60 on July 13, 2022 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 1941 UNIVERSITY AVENUE WEST; and
WHEREAS, the Legislative Hearing Officer reviewed this case on January 24, February 14 and February 28, 2023 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated and the Building Official reported no permits had been pulled and no progress made toward the rehabilitation of the dangerous accessory structure at this property; and
WHEREAS, at those Legislative Hearings the Legislative Hearing Officer reviewed materials submitted by property ownership to determine whether the conditions required for a recommended grant of an extension had been met, and on February 28, 2023 was able to make the finding they had been; and
WHEREAS, those conditions, an updated scope of work, including a schedule and bids, as well as updated evidence of financing to complete the project were submitted by the appellant, reviewed by Department of Safety and Inspections and the Legislative Hearing Officer and found acceptable;
WHEREAS, based on this review, the Legislative Hearing Officer recommends the continuance of the $5,000 performance deposit and the grant of an additional 180 days for completion of rehabilitation;
WHEREAS, the Legislative Hearing Officer will review whether the dangerous condition at this property has been abated at the conclusion of the 180 days, on the September 12, 2023 Legislative Hearing and report to the Council with findings and a recommendation shortly thereafter; the Legislative Hearing Officer recommends referring the matter back to February 14, 2023 Legislative Hearing to review further; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated, but continues the performance deposit and grants an additional 180 days for the abatement of the dangerous conditions. forthcoming, pending the February 14, 2023 Legislative Hearing.
