Appeal of Kathy Bauer, dba Capital View Cafe, to a Fire Certificate of Occupancy Approval With Corrections at 635 and 637 SMITH AVENUE SOUTH .

Purpose of Appeal:
Capital View Cafe has been cited for a roof drainage violation. This building has been here many years, and the roof drainage has always remained the same for over 30 years. The only change that have taken place is a female in 2018 purchased the cafe. Now this seems to be a very costly issue. Not sure why it was sufficient for 30 years and now an issue. At this time, we do not have the funds to correct this. Not even sure it can be. With endless COVID shutdowns and additional expenses, funds are tight.
I am asking that this be grandfathered in. Or put off for 5 years extension.
I would greatly appreciate any assistance in this matter you could offer.

WHEREAS, in the matter of the Appeal of Kathy Bauer, dba Capital View Cafe, to a Fire Certificate of Occupancy Approval With Corrections at 635 and 637 Smith Avenue South, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant to July 1, 2023 for compliance; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
