Purpose of Appeal: Garage is detached and not in use due to garage condemnation requirement. Request to review for conditional certificate of occupancy for the house until reinspection of garage repairs complete.

Legislative Hearing Staff Comments: Appellant writes "Due to family health emergency...request hearing is Oct 18 or later." Staff spoke to appellant who says that he is going to Egypt because of a death in his family and does not know what the phone reception will be while he is there; therefore, he did not want the hearing to be on October 12. He told staff that garage is not in use. Staff accommodated this request and told him that this hearing will not be rescheduled because it is a condemnation and is scheduled out further than normal.

WHEREAS, in the matter of the Appeal of Tamer Azzazi to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 1843 MINNEHAHA AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant to January 1, 2022 to have garage structure braced, repaired or removed; and

WHEREAS, the owner submitted an additional engineering analysis November 30, 2021 suggesting permanent bracing, repair or removal of the structure could happen as late as July 2022; and

WHEREAS, the Legislative Hearing Officer reviewed the newly submitted analysis with the City's structural engineer and now recommends that "temporary bracing" be required as of March 1, 2022 on the condition that the structure not be used for any purpose unt...
