WHEREAS, the Cigarette/Tobacco license held by Razan Inc. d/b/a Winnipeg Grocery (License ID #20190000793) at 864 Rice Street in Saint Paul was the subject of a Notice of Violation Recommendation for imposition of $1000 matrix penalty on March 23, 2021
WHEREAS, the Notice stated that during a follow up inspection of the licensed premises on March 3, 2021 an inspector from the Department of Safety and Inspections (DSI) observed and documented with a photograph a box ‘Black and Mild’ - Wine in violation of Saint Paul Legislative Code § 324.07 (f) ; and
WHEREAS, On October 15, 2020 the licensing office also recommended imposition of a $500.00 matrix penalty in a Notice of Violation for selling menthol cigarettes and flavored cigars documented by an DSI inspector on October 8, 2020, which licensee paid the penalty on December 21, 2020: and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $1000.00 matrix penalty: and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $1000.00 matrix penalty or request a public or administrative hearing: and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $1000.00 matrix penalty or request a public or administrative hearing by April 6, 2021 that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Razan Inc. d/b/a Winnipeg Grocery (License ID #20190000793) at 864 Rice Street in Saint Paul is hereby ordered to pay a $1000.00 matrix penalty
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
