WHEREAS, the City Council adopted RLH RR 20-15 on April 8, 2020 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 2022 Stillwater Avenue; and

WHEREAS, the Legislative Hearing Officer reviewed this case on October 13, 2020 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated and with the building inspector reported 50% of the rehabilitation is completed; and

WHEREAS, the Legislative Hearing Officer recommends that the City Council continue the current $5,000 performance deposit and grant an additional 180 days to complete the rehabilitation or removal of the property, if the owner submits: 1) updated work plan, bids and schedule to complete the rehabilitation; 2) updated financial information demonstrating the capacity to finish the work, or evidence the contractors have been paid in full; 3) the vacant building fee must be paid before additional permits will be issued;

WHEREAS, the Legislative Hearing Officer's recommendation is forthcoming pending the results of the above conditions being met to grant to January 1, 2021, noting that 1) evidence some of the contractors have been paid in full was not presented; and 2) the revised work plan indicates the property's rehabilitation will be completed by the end of November, 2020; now, therefore, be it

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated and grants an additional 180 60 days, to April 28 January 1, 2021 to rehabilitate or remove the structure, pending the above-listed conditions being met October 27, 2020; and Be It Further
