Authorizing the City to enter into an agreement with Ramsey County for Right of Way acquisition related to reconstruction of Cleveland Avenue from Como Avenue to Larpenteur Avenue.
Body
WHEREAS, Ramsey County desires to reconstruct Cleveland Avenue from Como Avenue to Larpenteur Avenue, a portion of which falls within the City of Saint Paul; and
WHEREAS, the proposed reconstruction requires acquisition of Right of Way (ROW) for construction impacts and stormwater treatment; and
WHEREAS, the ROW acquired under this agreement will be owned and maintained by Ramsey County; and
WHEREAS, the County’s cost participation policy requires the City to finance 50% of the ROW costs within the City of Saint Paul; and
WHEREAS, the City’s share of the estimated cost of the ROW acquisition is included in the 2020 Capital Improvement Budget; and
WHEREAS, the agreement includes a mutual indemnification clause, which Council finds reasonable and necessary to pursue ROW acquisition; now, therefore, be it
RESOLVED, that the Mayor and the proper City Officials are hereby authorized and directed for and on behalf of the City to enter into Ramsey County Agreement PUBW2020-06R, a copy of which is before the Council and is made a part hereof; and be it finally
RESOLVED, that the Mayor and the proper City Officials are authorized to execute the Agreement and any amendments to the Agreement.
