Granting a temporary construction easement to the Minnesota Department of Transportation over a portion of city-owned Dunning baseball and softball fields.
Body
WHEREAS, the City of Saint Paul ("City") owns land adjacent to Dunning baseball and softball fields at 1221 Marshall Avenue and 1142 Concordia Avenue, Saint Paul (the "Property"). The Property is maintained by the Department of Parks and Recreation ("Department"); and
WHEREAS, the Minnesota Department of Transportation ("MnDOT") is using the Property for work space and storage during the reconstruction of the Dunning driveway access related to improvements to Highway 94; and
WHEREAS, MnDOT requires a temporary construction easement area at the time of commencement and terminating on December 1, 2023; and
WHEREAS, MnDOT is offering to purchase said easement for One Thousand Five Hundred Fifty and 00/100 Dollars ($1,550); and
WHEREAS, the Real Estate Manager has determined this to be a fair and reasonable value as determined by an appraisal and agreed to between the City and MnDOT; now, therefore be it
RESOLVED, by the Council of the City of Saint Paul, that the proper City officials are hereby authorized and directed to grant a temporary easement to MnDOT, in a form and content substantially as set forth in Exhibit A attached hereto, and to accept payment for said easement, to be deposited in the proper Department account.
