WHEREAS, The Essence Event Center Inc, d/b/a The Essence Event Center (License ID # 20200000193) located at 1217 Bandana Boulevard North, has applied for Class N licenses for Liquor On Sale - 291 or more seats, Liquor On Sale - Sunday, and Entertainment (B); and
WHEREAS, in response to notification from the Department of Safety and Inspections regarding the license application, the City received objections to the Liquor On Sale - 291 or more seats, Liquor On Sale - Sunday, and Entertainment (B) licenses which were received within the notification period, and a hearing was held on April 13, 2020; and
WHEREAS, licensee was required to seek support from a list of private residences, dwellings and apartment houses within a 350-foot radius of licensee's proposed Entertainment B license at 1217 Bandana Boulevard North that was provided by the Department of Safety and Inspection by signatures of approval on petitions; and
WHEREAS, the licensee was able to obtain two (2) of a possible two (2) petition signatures for one hundred percent (100%) support for an Entertainment B license; and
WHEREAS, the Council finds that these efforts constitute a good-faith effort to fulfill all petition requirements, and that the results of the obtained signatures showed a generally favorable disposition from the surrounding community toward the proposed licensed activity; and
WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; and
WHEREAS, after conducting the hearing and considering the submitted materials and testimonies, the Deputy Legislative Hearing Officer recommends that the application for Liquor On Sale - 291 or more seats, Liquor On Sale - Sunday, and Entertainment (B) licenses for The Essence Event Center Inc, d/b/a The Essence Event Center (License ID # 20200000193) at 1217 Bandana Boulevard North, be approved with the following conditions:
1. No liquor sales, service, display and/or consumption is allowed outdoors without prior written approval and additional licensing from the Department of Safety and Inspections (DSI).
2. Licensee agrees to abide by Minnesota State Statute Section 340A.504 Subd. 3 stating that Sunday liquor sale/service/display/consumption may only occur in conjunction with the service of food by the licensed establishment for consumption on the premises.
3. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patrons/customers/guests shall vacate the premises at 12:30 a.m. each day of the week as per City Zoning Code (parking requirement).
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions.
