Title

Making finding on the appealed nuisance abatement ordered for 830 UNIVERSITY AVENUE WEST in Council Files RLH RR 18-22 and RLH RR 18-53.

 

Body

WHEREAS, the City Council adopted RLH RR 18-22 on June 27, 2018 which granted an extension for 180 days to abate the nuisance conditions at 830 University Avenue West; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on December 27, 2018 and January 15, 2019 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated;

 

WHEREAS, a new work plan with updated bids and deadlines, as well as evidence of financial capacity to complete the rehabilitation, has been reviewed and approved by the Legislative Hearing Officer and Code Enforcement Manager; and

 

WHEREAS, the performance deposit required for this work was originally posted on June 11, 2018; and

 

WHEREAS, the Building Official has made a determination that the rehabilitation was more than 50% complete 180 days following the Council's grant of time on June 27, 2018; and

 

WHEREAS, the Legislative Hearing Officer recommended that the performance deposit be continued and additional time be granted for the abatement of the nuisance/dangerous conditions at this property; and

 

WHEREAS, the City Council adopted RLH RR 18-53 on February 6, 2019 which granted to June 10, 2019 for the completion of the rehabilitation and continued the $5,000 performance deposit to that date; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case again on June 11, 2019 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were abated; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is abated and the matter resolved.
