Title

Request Review of Council File RLH VO 18-49 adopted on October 10, 2018 for Appeal of Lynn Fagerness to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 1127 RAYMOND AVENUE.

 

Body

WHEREAS, in the matter of Appeal of Lynn Fagerness to a Revocation of Fire Certificate of Occupancy and Order to Vacate at 1127 RAYMOND AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council  grant an extension to December 1, 2018 for the roof repair and Unit 6 stairway repairs, noting that if the roof is repaired and not the Unit 6 stairway, Unit 6 will need to be vacated; and

 

WHEREAS, on October 10, 2018, the City Council accepts and adopts the Legislative Hearing Officer's recommendation in this matter; and

 

WHEREAS, on December 4, 2018, an inspection was conducted and found owner has failed to come into compliance with the repairs and ordered Unit 1 to be vacated; and

 

WHEREAS, Lynn Fagerness contacted the City Council Offices for clarification of enforcement for Unit 1 since the roof was not in compliance; and

 

WHEREAS, a Legislative Hearing has been scheduled for December 11, 2018 to review the matter.
