Appeal of Hayley (Thomas) Ball and Emerson Ball to a Correction Notice at 1253 ALAMEDA STREET NORTH.

 

Date/Time of 1st LH:  October 3, 2017, 11:00 a.m.

Purpose of Appeal:   The retaining wall that we were issued a correction notice for is not on our property.  We had a survey completed that shows the wall is not on our property.  We have been trying to work with our neighbors who own the wall since February 2017 to find a solution and bring the wall up to code.  Those neighbors have also been removing pieces of the retaining wall.  As the wall is on their property, we couldn't even begin work on the wall without their permission.  They also made conditions for contractors to work on the wall that are unreasonable and have delayed the process considerably.

WHEREAS, in the matter of Appeal of Hayley (Thomas) Ball and Emerson Ball to a Correction Notice at 1253 ALAMEDA STREET NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant;

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension to June 1, 2018 to comply with the retaining wall; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
