Authorizing an extension for staff to complete final contract negotiations with the currently licensed residential trash collectors with final deadline for Council approval on November 8, 2017 and reinstating the Options Committee.

WHEREAS, Minnesota Statute § 115 A.94, et. seq. authorizes a city to organize trash collection and creates a required procedure a city must follow to organize collection of trash which includes a requirement that a city negotiate with currently licensed residential trash collectors for a minimum of sixty (60) days before considering any other options; and

WHEREAS, in RES 16-1300, the City Council designated August 1, 2016 as the official date to begin the statutorily-required 60-day negotiation period with currently licensed residential trash collectors; and

WHEREAS, after eleven months of preliminary negotiations, on July 26, 2017 in RES 17-203, the City Council authorized City staff to negotiate a final and complete contract with representatives of the existing licensed residential trash collectors that was to be approved by the Council no later than October 4, 2017; and

WHEREAS, RES 17-203 also suspended the Organized Collection Options Committee during the final contract negotiation process; and

WHEREAS, on October 4, 2017 in RES 17-1581, the Council authorized an additional two-weeks to continue final contract negotiations with a deadline of October 18, 2017 for approval by the Council of a final contract; and

WHEREAS, RES 17-1581 further stated that “if a final contract is not submitted for approval, the Council will consider whether to reinstate the Options Committee process at the October 18, 2017 Council Meeting”; and

WHEREAS, City staff have not been able to come to an agreement on all terms of a final contract with the existing licensed residential trash collectors; and
