Authorizing a two-week extension for staff to finalize contract negotiations with the currently licensed residential trash collectors.
Body
WHEREAS, Minnesota Statute § 115 A.94, et. seq. (hereinafter “Statute”) authorizes a city to organize trash collection and creates a required procedure a city must follow to organize collection of trash; and
WHEREAS, in RES 16-1300, the City Council designated August 1, 2016 as the official date to begin the required 60-day period; and
WHEREAS, the City has negotiated in good faith and received a seventh proposal on July 7, 2017, signed by the fifteen existing licensed residential trash collectors, which includes Advanced Disposal, Aspen Waste Systems, East Metro Environmental, Gene’s Disposal Service, Highland Sanitation, Garbage Man 1, Garbage Man 2, Ken Berquist & Sons, Krupenny & Sons, Pete’s Rubbish Hauling, R&M Sanitation, Republic Services, Triangle Rubbish Service, Walters Recycling and Refuse Inc., and Waste Management; and
WHEREAS, on July 26, 2017 in RES 17-203, the City Council authorized City staff to negotiate a final contract with representatives of the existing licensed residential trash collectors that was to be approved by the Council no later than October 4, 2017; and
WHEREAS, the October 4, 2017 deadline was based on ensuring the City had enough time to adopt an administrative fee to pay for the City’s expenses to implement and manage Coordinate Collection in 2018; and
WHEREAS, since July 26, 2017, City staff have met six times with representatives of the trash collectors but have not been able to come to an final agreement; and
WHEREAS, City staff believe that a two-week extension would provide enough time to complete negotiations; and
WHEREAS, the Office of Financial Services has advised that a two-week extension will allow enough time to adopt the administrative fee; now, therefore, be it
