Title

Granting a stay to provide an extension of Council File No. RLH RR 16-9, an Order to Remove or Repair the Structures at 839 THOMAS AVENUE. 

 

Body

WHEREAS, in the matter of an Order to Remove or Repair the Structures at 839 Thomas Avenue, the Saint Paul Council granted the owner John McKusick, 45 days for the razing and removal of the building(s) at this property;

 

WHEREAS, the City Council further indicated that in the event Mr. McKusick did not complete the rehabilitation within the time allotted, JN Homes, LLC, the lien holder, could be allowed to request a stay of enforcement in order that they may complte the rehabilitation of the structure; and

 

WHEREAS, in the 45-day time period, John McKusick, property owner failed to meet the time allotted;

 

WHEREAS, a Legislative Hearing was conducted on September 13, 2016 for Jared Goerlitz, on behalf of JN Homes, LLC to meet the requirements requested of the Legislative Hearing Officer;

 

WHEREAS, compliance with these conditions was carefully reviewed by both the legislative hearing officer and the vacant building program manager and found to be acceptable; now, therefore, be it

 

RESOLVED, that the City Council grants a stay in the implementation of Council File No. RLH RR 16-9; and be it further

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, granting a stay to December 31, 2016 for the completion of the rehabilitation of the property.
