Approving adverse action against all licenses held by Metro Bar & Grill, Inc., d/b/a Arnellia’s at 1183 University Avenue West.
Body
WHEREAS, all licenses held by Metro Bar & Grill, Inc., d/b/a Arnellia’s (License ID# 0054523) for the premises located at 1183 University Avenue West in Saint Paul were the subject of a Notice of Violation dated July 8, 2016, stating the licensee was cited for the sale of alcohol to two (2) underage persons; and
WHEREAS, the sales took place inside the licensed premises during a Liquor Compliance Check (CN #16-128-583) conducted by Saint Paul Police on June 2, 2016; and
WHEREAS, the sale of alcohol to an underage person is a violation of both Minn. Stat. § 340A.503, Subd. 2 (1) and Saint Paul Legislative Code § 409.08 (2) (a); and
WHEREAS, the violation is directly related to the licensed activity, per Saint Paul Legislative Code § 409.26 (b) (3), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee responded to the Notice of Violation with a letter requesting a public hearing which was re-scheduled on September 21, 2016; now therefore, be it
RESOLVED, Metro Bar & Grill, Inc., d/b/a Arnellia’s is hereby ordered to pay a $500.00 matrix penalty for the sale of alcohol to two (2) underage persons in violation of Minn. Stat. § 340A.503, Subd. 2 (1) and Saint Paul Legislative Code § 409.08 (2) (a).
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
