WHEREAS, City Council File RLH RR 14-2 which ordered the rehabilitation or razing and the demolition of the structure of 349 Curtice Street East within 180 days after the February 19, 2014 City Council Public Hearing; and
WHEREAS, the mortgage holder, Bank of America, is now in possession of the property and has met the following conditions in order for the Legislative Hearing Officer to recommend that the Saint Paul City stay enforcement of the above-referenced order and allow time for the rehabilitation of the property:
1. A new code compliance inspection report was obtained, dated April 16, 2015;
2. New bids and a new work plan consistent with the code compliance inspection report were provided;
3. Documentation of financing sufficient to complete the project has been demonstrated;
4. A $10,000 performance deposit was posted with the Department of Safety and Inspections (this is refundable upon completion of the project within the time allotted);
5. Vacant building fee payments are current;
6. The property has been maintained; now, therefore, be it
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, granting a 90-day in the enforcement of RLH RR 14-2, which ordered the rehabilitation or removal of 349 Curtice Street East.
