Legislative Hearing Staff Comments:  This file is being forwarded for an approval; however, the minutes have not yet been completed.  We anticipate they will be done by noon Thursday February 26 due to staff illness and other delays.  I will contact Councilmembers that morning with fresh information, so they may amend the files as they see fit. AMENDED 3/18/15

WHEREAS, in the matter of Appeal of Timothy McCormick to a Fire Inspection Correction Notice at 1191 REANEY AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant the following deadlines for the orders issued on January 22, 2015:

 

1) grant until March 9, 2015 for a plan on the handrail to be submitted to DSI (Items #8 and #9);

2) grant until June 1, 2015 for guardrail (Item #2) and concrete stairs (Item #2);

3) grant until June 1, 2015 for the parking space issue (site plan to be submitted to Zoning);

4) grant until October 1, 2015 for garage repairs and painting (Item #1);

5) grant until March 13, 2015 for the rest of the items; and

 

WHEREAS, the Legislative Hearing Officer also recommends that the City Council grant the mattress and tires (Item #4) to be withdrawn on from the Fire Correction Order and transferred to Code Enforcement for a summary abatement order;

 

WHEREAS, the Legislative Hearing Officer also recommends that the City Council grant the fence appeal (Item 1) and notes that the Fire Inspector anticipates withdrawing the order as the fence is connected to the neighbor's property, and not that of the appellant; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
