AMENDED 5/16/12
WHEREAS, in the matter of the Appeal of Charles Belcher to a Re-Inspection Fire Certificate of Occupancy With Deficiencies at 733 JENKS AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
 
WHEREAS, the Legislative Hearing Officer recommends that the City Council 1) grant a 7-inch variance on the openable height of the egress window in the second floor north bedroom; and 2) for the second floor southern window - grant up to a 3-inch variance in egress opening height and a 10 inch variance on minimum sill height if window style is changed to a casement and 2 standard sized steps are installed for the length of the window; 3) deny the appeal for the second floor west and east and south bedrooms and grant an extension to June 1, 2012 for tenants to vacate the these rooms on the second floor for sleeping purposes; Now, Therefore, Be It
 
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
