There are no specific measurements in the orders, beyond indicating that 1/2 of the room is not over 7 feet. On the surface, this case may be a candidate for a variance, but more specific information is needed for the hearing.
Also, it looks as if the C of O has been issued and this went to billing. However, the ceiling height is listed as "abated" at the same time that it is being appealed. Please advise on this at hearing.

WHEREAS, in the matter of the Appeal of Xuan Hguyen to a Fire Certificate of Occupancy Correction Notice at 1227 MAGNOLIA AVENUE EAST, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant a 5-inch variance on the attic ceiling height; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
