Purpose of Appeal: The property was temporarily unoccupied when we closed restaurant operations, but we are resuming on-site daily activities there as a test kitchen (not open for the public).

Legislative Hearing Staff Comments: Appellant told staff that she spoke to Steve Magner today (November 13) and he okayed this late appeal.
Mr. Magner left a message with the following: the appellants called a few weeks ago and was told to file an appeal. They called yesterday and was told again to file an appeal. If we are okay with an appeal being filed, DSI is okay with it.

WHEREAS, in the matter of the Appeal of Erin Marissa, Taher Real Estate, to a Vacant Building Registration Fee at 276 EXCHANGE STREET SOUTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal; waive the vacant building fee for 90 days and allow permits; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
